What data do we collect?

The server only logs times and requests. The IP numbers are not stored. Therefore, your use of this server will not result in any personal data being collected. Also, there are no registration requirements or communication features.

Cookies and external service providers

No cookies are stored on this server. There are no social media buttons or logins and the google custom search has been dropped as of 2019.

What personal data is published?

A large number of court cases contain personal information, sometimes of the parties, more often of the lawyers engaged. These court cases are public documents and there is an overriding public interest in keeping their integrity. The analysis of case law also falls under the freedom to conduct historical and legal research and its publication falls under the free speech guarantee. For precision and consistency, the court cases are published here exactly as they were published by the respective authorities.
However, if you feel that your name should no longer appear in the court case's publication, you can contact the court with a request to anonymize the source. Once this has happened, you can send an e-Mail so we can adjust the document on this server. It will then reflect the same degree of anonymity as the newly published version of the court.

Your right to be forgotten

Within the European Union (i.e., with no direct application in Switzerland), the General Data Protection Regulation (GDPR) acknowledges that every person has the right to request erasure of personal data if the legitimate interests of the publisher (free speech, freedom of research) and the information interests of the public (freedom of information) are overridden by the interests of that person (privacy rights). This is a matter of balancing done by the courts. Therefore, if the court decides in favor of publishing personal data, there is a strong indication that the information interest is not overridden by the personal interest in keeping it hidden.
